The Participant of the Hong Kong Innovation & Invention ("the Participant”) hereby represents and warrants that the innovation/invention exhibit (including but not limited to exhibit/project names, photos, videos, text descriptions, award certificates, intellectual property documents, etc.) submitted for Hong Kong Innovation & Invention (“Project”) is original and does not infringe, breach, prejudice or violate the property, interests or rights (including but not limited to contractual rights, user rights, copyrights, design rights, patents and all other proprietary and intellectual property rights whether registered or otherwise) of any third party.
The Participant hereby acknowledges and warrants that it is a company that owns the innovation/invention exhibit or the Participant is its services provider. The exhibit is created either by the in-house or outsourced service company.
The Participant hereby grants, on a gratuitous basis free of any fee, royalty or remuneration, to the Hong Kong Exporters’ Association (“HKEA”), the organizer of the Project, the right or license to use, edit, amend, copy, reproduce or publish in any size the innovation/invention exhibit information submitted for the Project or any part thereof in the promotional/exhibition materials or any publications in any media or medium related to the Project.
The Participant agrees to fully indemnify HKEA against all actions, claims, loss, damages, costs and expenses which it may incur or has incurred as a result of any breach of this representation or warranty.
The Participant agrees and makes full payment of the application fee(s) (if applicable) to HKEA before the submission deadline. All fees submitted for the Project are non-refundable under all circumstances.
The Participant agrees that the decisions of the Selection Panel regarding the innovation/invention exhibit vetting shall be final. No appeal will be entertained.
The Participant shall be responsible for all costs (including but not limited to all packaging costs, transport costs, documentation, postal charges, courier charges, bank charges, insurance costs, governmental/jurisdictional approvals and licenses and any other costs necessary or likely) in the passing and transport of the Participant’s Exhibit(s) into the possession of HKEA.
HKEA will not provide advance payment for deliveries (including import and export duties, insurance premiums, and food inspection fees, etc.). Participants are liable for any damages to their innovation/invention entries and should pack carefully for transport and arrange for insurance coverage.
While every precaution will be exercised in the handling of entries received by HKEA, HKEA accepts no liability for any loss or damage of any kind whatsoever for any physical products submitted. It is advisable for the Participants to arrange liability insurance for their innovation/invention entries.
The Participant agrees that their innovation/invention exhibit(s) chosen after the vetting process will be displayed in such exhibitions at the decision of HKEA for a period of a minimum of 1 year subsequent, and agrees to provide information as requested by HKEA about the innovation/invention exhibit for future activities, including but not limited to reports, publicity, marketing and exhibitions.
HKEA is not responsible for any loss or damage that may or may be infringed by participating entries arising out of or in connection with any material (including the product, data, images, video, text, etc.) posted or displayed in this project.
These terms and conditions shall be governed by the laws of the Hong Kong Special Administrative Region. Any claim or dispute must be determined exclusively by the courts in the Hong Kong Special Administrative Region after the event has ended. HKEA reserves the right to make further amendments to these terms and conditions which shall be binding on all Participants. Such amendments shall be posted on the Project official webpage, and further notice will not be given.
These terms and conditions are prepared in English and Chinese languages. If there is any inconsistency between these versions, the English version shall prevail. Please visit the Project website www.hk-ii.com for the most up-to-date information.
